This offense is taken very seriously by the UAE’s judicial system, and offenders may face severe penalties if found guilty. The UAE’s legal system primarily relies on a combination of civil and Sharia law principles. For crimes like assault and battery, the UAE Penal Code, Federal Law No. 3 of 1987, plays a central role. According to the Code, anyone found guilty of assault can face imprisonment for up to one year and/or a fine of up to AED 10,000 (approximately 2,722 USD). The penalty for battery is more severe, with imprisonment ranging from three months to three years.
The severity of the punishment can be significantly increased if the battery offenses are committed under certain aggravating circumstances. For example, if the perpetrator uses a weapon during the attack, the punishment may be elevated to a minimum of one year’s imprisonment. Moreover, if the victim sustains serious injuries or if the battery is committed against a public servant carrying out their duties, the penalties may be increased accordingly.
The UAE’s legal system strives to be culturally sensitive while ensuring the protection of personal safety. In some cases, self-defense may be considered a valid argument if a person uses reasonable force to protect themselves or others from harm. However, the degree of force used must be equal to the threat faced. The UAE courts will carefully assess the situation to determine whether self-defense is a legitimate defense against battery charges.
